Terms of Service

These terms are the agreement between you and FO Squad, Inc. for using SOKEN. By creating an account or using the app, you accept them. If you do not accept them, do not use SOKEN.
They are written to be read. Where a section has to be formal, there is a plain-English sentence next to it saying what it means.
Read this first
SOKEN is not medical advice
SOKEN observes and presents published research about food. That is the whole of what it does. Specifically:
- SOKEN is not a medical device, and it gives no medical advice, diagnosis, or treatment. It is not regulated as a medical device and is not intended to be one.
- It presents general research findings, not personalised health guidance. What SOKEN shows you is what studies have reported about foods in general. It is not a statement about your body, your health, or what will happen to you.
- It must not be used to diagnose, treat, cure, or prevent any disease.
- It is not a substitute for a qualified healthcare professional. Talk to a doctor or a registered dietitian before you change your diet — and especially if you have a medical condition, take medication, are pregnant or breastfeeding, or have or have had an eating disorder. If food and eating are a source of distress for you, please speak to a professional rather than to an app.
- SOKEN’s food analysis is produced by an AI model and can be wrong. It can misidentify a food, miss an ingredient, misjudge a portion, or produce a confident answer that is simply incorrect. Never rely on it for an allergen, medical, or safety decision. If you have an allergy or intolerance, check the actual product label and ask the person who prepared the food. SOKEN cannot tell you what is safe for you to eat.
If you have a medical emergency, call your local emergency number. Do not use SOKEN, and never delay getting medical help because of something an app showed you.
1. Who this agreement is with
SOKEN is published by FO Squad, Inc., a Nevada corporation, doing business as SOKEN. This agreement is between you and FO Squad, Inc., and nobody else.
Where these terms say “we” or “us”, that is who they mean. Where they say “you”, they mean the person using the app.
How your information is handled is set out in the Privacy Policy, which forms part of this agreement.
2. SOKEN is not medical advice
See the block at the top of this page. It is part of these terms, and it is the most important part. By using SOKEN you confirm you have read it.
3. Eligibility: 18 and over
You must be 18 or older to use SOKEN. By creating an account you confirm that you are.
This is not a formality. SOKEN discusses food, diet, and body weight, and that combination is not appropriate for children or teenagers. If we learn that an account belongs to someone under 18, we will close it and delete the data attached to it.
You also confirm that you have the legal capacity to enter into this agreement, and that using SOKEN does not break any law where you live.
4. What SOKEN is, and what it is not
What it is. SOKEN is an app for photographing food. It analyses the photo with an AI model, gives the meal a verdict, keeps the result in your history, and shows you patterns over time across six body systems. It presents what published research says about the kinds of food you eat.
What it is not. To be as clear as possible:
- It is not a medical device, a diagnostic tool, or a health service.
- It is not a dietitian, a nutritionist, a doctor, or a substitute for any of them.
- It is not a calorie counter or a clinical nutrition database, and its numbers are not measurements.
- It is not an allergen checker, and it cannot tell you whether a food is safe for you.
- It is not a weight-loss programme, and it does not promise any health outcome.
- It does not claim that eating a particular food will cause a particular result in your body. It reports what research has observed. Association is not causation, and SOKEN does not pretend otherwise.
The scores, verdicts, body-system states, and any age-style figure the app shows are informational summaries produced by software. They are not measurements of your body and they are not clinical findings.
5. Your account and your sign-in links
You sign in with a one-time link sent to your email address. There is no password.
That link is the key to your account. Anyone who has it can get in. So: keep your email account secure, never forward a sign-in link to anyone, and never post one anywhere. If you think someone else has got into your account, email us at support@sokenhealth.com straight away.
You are responsible for what happens under your account. Give us an email address that is really yours and that you can access. One person per account, please, and do not let anyone else use yours.
6. Acceptable use
Do not:
- Use SOKEN for anything illegal, or to harm anyone
- Upload photos that are not yours to upload, or that contain other people who have not agreed to it
- Upload anything unlawful, abusive, hateful, sexual, or designed to distress someone
- Try to break, overload, or get around the app’s limits, security, or paywall
- Scrape the service, automate it, or run it through bots or scripts
- Reverse-engineer, decompile, or copy the app, except where the law says you may despite this clause
- Resell SOKEN, or pass its output off as your own product or as professional advice
- Use SOKEN’s output to give anyone else medical, dietary, or clinical advice
- Try to make the AI produce harmful content, or use SOKEN to build or train a competing model
If you break these rules we may suspend or close your account. Where it is reasonable to do so, we will tell you why first.
7. Subscriptions, renewals, and refunds
Some features need a paid subscription. Prices and trial lengths are shown in the app before you buy, in your local currency.
Payment goes to Apple or Google, not to us. You buy through your App Store or Google Play account, under their terms. We never see your card details.
Auto-renewal
Subscriptions renew automatically. Unless you cancel, your account is charged for another period at the end of the current one, at the price then shown for that plan.
Free trials
If a plan comes with a free trial and you do not cancel before the trial ends, the trial rolls into a paid subscription and you are charged. The app offers a reminder before that happens, but the responsibility for cancelling in time is yours.
Cancelling
Cancel through your app store account settings, not in SOKEN. On iOS: Settings, then your name, then Subscriptions. On Android: the Play Store app, then Payments and subscriptions. We cannot cancel a subscription for you, and deleting the app does not cancel it.
If you cancel, you keep access until the end of the period you have already paid for.
Refunds
Refunds are handled entirely by Apple or Google under their own policies. We do not process payments, so we cannot issue a refund even when we would like to. Ask them directly. If you are a consumer in the EU or the UK, you keep your statutory rights, including any right to withdraw from a purchase — those rights are not affected by anything in this section.
Price changes
If the price of a plan changes, the new price applies from the next renewal, and you will be told in advance through the app store in the way its rules require. You can cancel before it takes effect.
8. Your photos and your content
Your photos stay yours. Photographing a meal does not transfer any ownership of it to us. You keep every right you had.
To run the app we need a narrow permission, and only that. By uploading a photo you give us a non-exclusive, worldwide, royalty-free licence to store it, send it to the AI provider that analyses it, process it to produce your verdict, and show it back to you in your own history.
That licence exists only to operate SOKEN for you. It does not let us publish your photos, use them in marketing, sell them, give them to anyone beyond the providers listed in the Privacy Policy, or use them to train our own models. The licence ends when you delete the content or your account, except for copies that survive briefly in routine backups.
You are responsible for what you upload. By uploading, you confirm you have the right to, and that doing so breaks no law and nobody else’s rights.
The verdicts and analysis SOKEN produces from your photos are yours to use for yourself.
9. Our content
SOKEN — the app, its design, its artwork, its text, its name and logo, and the scoring method behind the verdicts — belongs to FO Squad, Inc. and is protected by copyright and other laws.
You get a personal, non-transferable, non-exclusive, revocable licence to use the app on devices you own, for yourself, while you follow these terms. Nothing more is granted, and nothing is transferred to you.
Research findings, study results, and nutritional facts that SOKEN cites belong to whoever published them; SOKEN cites them, it does not own them.
10. Availability and changes to the app
SOKEN is offered as it is, when it is available. We do not guarantee that it will be up, that it will work without errors, or that your data will never be lost. Features can change or be removed, and the app may be unavailable for maintenance, for reasons outside our control, or because a provider we depend on has a problem.
SOKEN is run by one person. If it were ever going to shut down for good, we would give you reasonable notice and a way to get your data out.
Keep your own copies of anything you cannot afford to lose. We are not a backup service.
11. Disclaimer of warranties
In plain English: SOKEN is provided as it is. We do not promise it will be accurate, available, or right for you, and you use it at your own risk.
TO THE FULLEST EXTENT PERMITTED BY LAW, SOKEN IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY ANALYSIS, VERDICT, SCORE, OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.
Some jurisdictions do not allow the exclusion of implied warranties. If you live in one, the exclusions above apply to you only as far as that jurisdiction allows, and your mandatory consumer rights are unaffected.
12. Limitation of liability
In plain English: if SOKEN causes you a loss, what we can be made to pay is capped at what you paid us in the last twelve months. Nothing here limits liability that the law does not allow us to limit — including for death or personal injury caused by negligence, or for fraud.
TO THE FULLEST EXTENT PERMITTED BY LAW, FO Squad, Inc. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE SOKEN, INCLUDING ANY RELIANCE ON ITS OUTPUT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO SOKEN IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS.
These limits apply whatever the legal theory, and even if we were told the loss was possible. They do not apply to liability that cannot lawfully be excluded or limited where you live, and they do not affect the statutory rights of consumers in the EU, the UK, or any other jurisdiction that grants them.
13. Indemnification
In plain English: if someone sues us because of something you did with SOKEN, you cover the cost.
You agree to defend, indemnify, and hold harmless FO Squad, Inc. from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your use of SOKEN, your breach of these terms, your violation of any law, your infringement of anyone else’s rights, or any content you upload. We will tell you promptly about any such claim and will not settle it without your agreement, which you will not unreasonably withhold.
14. Termination
You can stop using SOKEN at any time. To close your account and delete what we hold, follow section 6 of the Privacy Policy. Remember to cancel any subscription separately through your app store.
We can suspend or close your account if you break these terms, if we are required to by law, or if keeping it open would create a real risk to other users or to the service. Where it is reasonable, we will tell you why and give you a chance to put it right.
When this agreement ends, the sections that are meant to survive it do — the disclaimers, the limitation of liability, the indemnity, the governing law, and the dispute resolution terms.
15. Governing law
These terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules.
If you are a consumer living in the EU, the UK, or somewhere else with mandatory consumer protection law, this clause does not take away the protection of the law of the country you live in, or your right to bring proceedings in your local courts.
16. Resolving disputes
Talk to us first
If something goes wrong, email support@sokenhealth.com and describe the problem and what you want done about it. Most things can be sorted out this way. Both sides agree to try for 60 days before starting formal proceedings.
Arbitration
If that does not work, any dispute arising out of or relating to these terms or to SOKEN will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, in the State of Nevada or by remote hearing. Judgment on the award may be entered in any court with jurisdiction.
Exceptions
- Either of us may bring an individual claim in small-claims court instead, if it qualifies.
- Either of us may go to court for an injunction to stop misuse of intellectual property.
No class actions
Claims must be brought individually. Neither of us may bring a class, collective, or representative action, and an arbitrator may not consolidate more than one person’s claims.
You can opt out
You may opt out of this arbitration section by emailing support@sokenhealth.com with the subject line “Arbitration opt-out” within 30 days of first accepting these terms. Opting out costs you nothing and changes nothing else about your account.
If you are a consumer in the EU or the UK, this section applies only as far as the law where you live allows. Your right to bring a case in your local courts is unaffected.
17. If you got SOKEN from the App Store
Apple requires these points, and they are accurate:
- This agreement is between you and FO Squad, Inc. only. It is not with Apple, and Apple is not responsible for SOKEN or its content.
- Apple has no obligation to provide any maintenance or support for SOKEN. That is ours.
- If SOKEN fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price. Beyond that, Apple has no warranty obligation at all, and any other claim is our responsibility.
- Apple is not responsible for handling any claim you or a third party makes about SOKEN, including product liability claims, claims that it fails to meet a legal requirement, and consumer protection claims.
- If a third party claims SOKEN infringes their intellectual property, we are responsible for handling it, not Apple.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- You confirm you are not in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
18. Changes to these terms
We may update these terms. When we do, the “Last updated” date at the top changes and the new version appears here.
If a change materially affects your rights, we will tell you in the app before it takes effect. Carrying on using SOKEN after that means you accept the new terms. If you do not accept them, stop using SOKEN and close your account.
19. Everything else
- The whole agreement. These terms and the Privacy Policy are the entire agreement between us about SOKEN, and replace anything said before.
- If part of it fails. If a court finds any part of these terms unenforceable, the rest still stands.
- Not enforcing something is not giving it up. If we do not enforce a term straight away, we can still enforce it later.
- Transfers. You may not transfer your rights under these terms. We may transfer ours if SOKEN changes hands, and we will tell you if that happens.
- No partnership. Nothing here makes either of us the other’s employee, agent, or partner.
- Things outside our control. Neither of us is liable for a failure caused by something genuinely beyond our control.
